Order Summary:

This suit was initiated in the light of the proposal received from the office of District Sub-Registrar, Pakur, through letter no. 96/Ni, dated 22.03.2025, for recovery of deficiency stamp duty of Rs. 6.12,580.80 and registration fee of Rs. 4,59,435.60 found in the registered document no. 4399, dated 12.10.2015, submitted by the opponent in the course of registration. In the light of the proposal received, the suit was instituted and notice was issued to the opponent to present his side. A copy of the online payment receipt of Rs. 6,12,581.00 deposited as deficiency stamp duty on 27.03.2025 was filed by the opponent. Along with this, time was sought to deposit the deficiency registration fee in lieu of registration fee. District Sub-Registrar, Pakur has reported through its office letter No.-166/Ni, dated 22.04.2025 that the opposite party has deposited a total of Rs. 6,12,581.00 towards deficiency stamp duty through GRN No-2501409113 and a total of Rs. 4,59,436.00 towards registration fee through GRN No-2501723833. Observed the record. The amount of outstanding stamp duty and registration fee against the opponent has been deposited by them, which has been confirmed by the District Sub-Registrar, Pakur through his office letter No.-166/N., dated-22.04.2025. Since the amount of deficient stamp duty and registration fee has been deposited by the opponent. For this reason, there does not seem to be any justification to continue the proceedings of the described suit initiated against the opponent at present. In view of the aforesaid circumstances, further proceedings in the said suit are terminated
