The case in question is related to the cancellation of the Jamabandi created illegally in the Revenue Register II in the name of the opponent Kapil Dev Tiwari, Pakur, for the area of ​​03B-1350-05pur under Dag No. 240, 241 and 242 of Mauja Khapadajola of Pakur Achal. The then learned Sub-Divisional Officer, Pakur, in the order passed on 24.11.2000 in the I.V. Case No. 65/98-99, recommended cancellation of the Jamabandi in question. A notice was issued to the concerned party to present his side in support of his claim. The notice service report has been received. As per the report, the notice has been refused to be taken. This matter has been pending for a long time and it is clear that the opponent has no interest left in this case. Therefore, the decision is being passed on the basis of the documents available in the memory. From the documents available on record and from the observation of the show cause notice given earlier by the applicant, it appears that the land in question was settled by the former landlord through a settlement lease. But the settlement deed is not available in the record. Due to which the claim of the opponent cannot be confirmed. Similarly, it is also not clear on what basis the jamabandi of the land in question has been established in the name of the opponent. It is clear from the observation and study of the entire record that the land in question is government land of Anabadi account. No valid document related to the Jamabandi created in Register II in the name of the opponent has been filed in this court till date. Therefore, on the basis of the above discussion, the opponent Kapil Dev Tiwari of Pakur An order is given to delete the jamabandi created in the revenue register-II in the name. The Anchal Adhikari, Pakur is ordered to cancel the illegal Jamabandi in question within a week and take it into government possession and submit a report in this regard to the court. The proceedings of the Paad are terminated.
