The case in question is related to the cancellation of the Jamabandi created illegally in the Revenue Register II in the name of the opponent Master Sundar Das, Pakur, for the area of ​​02m-0520-15 dhur land under Jamabandi No. 31, Dag No. 311 and 171 of Mauja Khapadajola of Pakur region. The then learned Sub-Divisional Officer, Pakur has recommended cancellation of the Jamabandi in question by the order passed on 24.11.2000 in Sthal 210 V. Case No. 70/98-99. Notice has been issued to the concerned party to present his side in support of his claim. After receiving the notice, the opponent/heirs appeared but they did not file any paper/document in support of their claim. The service report of the final notice is received. This case is pending for a long time and till date the opponent has neither filed a show cause notice nor has filed any paper/document in support of the claim. It is not clear from the documents available on record that the Jamabandi has been created in the Revenue Register II in a valid manner. An objection application has been filed on 16.07.1999 by one Amalendra Chandra Pandey, father-Shri Kamalendra Chandra Pandey in the record. The said objection application was perused. From the perusal of the objection application it appears that the land in question was acquired by the former intermediate G.C. Pandey in the year 1912-13 under section 25A of the Rent Regulation Act, 1886 by the order passed by the Honourable Deputy Commissioner in Remis Case No. 481/1912-13 and by the order passed in Settlement Objection suit No.-40/1928 in the statement column of the Khatian "Puraan Patit Dakhal Khas Malik" and D.C's Rev. Misc Case No.-481/12-13 have been mentioned. From the perusal of the Khatian, the above statement appears to be correct. But from observation and study of the entire record, it is clear that Jamabandi has been created in the Revenue Register II in the name of the opponent without any valid papers/documents. Which is necessary to be deleted in the interest of the government. Therefore, on the basis of the above discussion, an order is given to cancel the jamabandi created in the Revenue Register II in the name of the opposite party Master Sundar Das, Pakur. The Zonal Officer, Pakur is ordered to ensure that the illegal Jamabandi in question is cancelled within a week. The case proceedings are terminated.
